England v Australia Terms and Conditions

1. Entrants to the 'England v Australia Cricinfo TwelfthMan Fantasy Cricket' game must be users of www.cricinfo.com. Employees and immediate family members of Cricinfo UK Limited and associated companies, partners, advertising and promotional agencies are not eligible to take part.

2. The 'England v Australia Cricinfo TwelfthMan Fantasy Cricket' game will commence on June 24, 2009 and run until Sep 20, 2009.

3. Please note that prizes for this game are ONLY available to UK residents and are based on the performances of all fantasy team managers who are UK residents.

4. The prize for the leading points scorer at the end of the game is an Ultimate Cricket Season Ticket for 2010 (the "Tickets").

This is one pair of tickets to the following:

* Each day of every England Home International Test Match
* Every England Home One Day International Match
* Every England Home International Twenty20 Match
* Friends Provident Finals Day
* Twenty20 Finals Day

5. The prize for second highest points scorer (runner up) at the end of the game is a full-sized bat signed by the England team.

6. The prize for the third highest points scorer (second runner up) at the end of the game is a full-sized bat signed by the England team.

7. Tickets (the “Tickets”)

Such Tickets are provided and can be used strictly subject to the following conditions:

A) The Tickets will be subject to, and the winner/ticket holder will be bound by, the ticket terms and conditions and any other relevant rules and conditions stipulated by each venue and/or otherwise governing that event.

B) The ECB and the venues have the right to refuse entry to the ground on matchday at their sole discretion.

C) No refunds will be given for any Ticket won in this competition and so tickets are not subject to the standard ECB refund policy.

D) Under no circumstances must any of These tickets be sold or traded in any way or otherwise used as part of any promotion. Subject to paragraph 5 below, the Tickets are non-transferable and in particular shall be invalidated and shall carry no right of entry for the holder where the ECB or venue has any reason to believe that it is intended to be or has been:
# sold, bundled transferred or otherwise disposed of for financial gain;
# used as a prize in a lottery, competition, or any other promotional advertising or other commercial purpose.

E) Notwithstanding paragraph 4 above, it may be possible to transfer some, not all, Tickets to a close family member or friend with the ECB’s prior written consent (such consent to be at ECB’s sole discretion) provided always there is no financial gain or commercial purpose.

F) The Ticket holder shall not engage in any form of “ambush marketing” (ambush marketing is an activity by a party which utilises the publicity value of an event without having any official involvement or connection with the event) and shall not breach or infringe the rights of any sponsors, suppliers, broadcasters or other parties commercially associated with the event or the venue, nor conduct any unauthorised promotions or other commercial activity.

G) Some, or all, matches Tickets may have to be collected at the venue on the match day where the winner (or agreed recipient) may be asked to produce a form of photo ID to redeem the prize.

H) The ECB will, once the ECB is notified, confirm to the winner which matches or match day each Ticket allows entry to. The ECB has the right to change the match in alignment with the match schedule. The ECB and the venue’s right to make alterations to the times, dates and venues of the revenant matches or matchdays in the event of any relevant circumstances or to substitute the seat or area to which the Ticket refers to another at its reasonable discretion is expressly reserved. Neither the ECB nor venue will be responsible or liable if the original Ticket is stolen or mislaid unless it determines that the Ticket holder has provided sufficient proof of actual loss, destruction or theft and the lost, destroyed or stolen tickets can be cancelled without loss.

I) The ECB and venue have no responsibility for any damage, loss, injury or disappointment suffered by you entering the competition or as a result of accepting and using the Tickets.

J) The ECB and venue may collect personal information about ticket holders which is necessary for it to operate, manage and promote certain events. In particular, the ECB and venue may collect the name, address and phone number of ticket holders for the purposes of coordinating the seating and/or viewing and/or security arrangements at the event. The ticket holder hereby consents to all such use.

8. The Bat

The competition organsiers will use all reasonable endeavours to deliver the signed bat within 56 days of the winner winning the bat, and posting the bat will constitute fulfillment of our obligations. Time will not be of the essence and the organisers cannot accept any responsibility for any damage, loss or disappointment suffered by late delivery of the bat or for any failure to deliver the bat due to inaccuracies in the address information provided by you or losses by the postal service.

The bat will be signed by some members of the England squad during 2009.

The Prize is non-transferable and no cash alternative will be offered.

9. The prize for the leading points scorer for each of the five Test matches is a Maximuscle goodie bag.

10. In the event of more than one user with the highest number of points in the overall game the fantasy player who entered the competition first will be the winner.

11. Entry to the competition is made by the entrant entering a fantasy team at the following URL - http://fantasy.cricinfo.com.

12. In order to enter the competition users must be an existing registered user of Cricinfo or register a new Cricinfo account when entering their team. There is no cash alternative to any of the prizes.

13. The decision of the judges is final. Cricinfo reserves the right to disqualify players who submit obscene or offensive information.

14. The winners will be notified by email no later than midday on Sep 21, 2009. Cricinfo will then agree with the winner for the best method of despatch of prize to the winner and the proof of despatch will be considered as proof of receipt. Octroi and taxes (if any) will have to be borne by the winners.

15. Cricinfo do not accept responsibility for late or undelivered entries, notifications or communications or for any technical failure, malfunction or difficulty or for any event which may cause the 'England v Australia Cricinfo TwelfthMan Fantasy Cricket' game to be disrupted or corrupted.

16. By entering the 'England v Australia Cricinfo TwelfthMan Fantasy Cricket' game, entrants agree to be bound by these terms and conditions, which are governed by English law.
